Performance Horses – ON SITE – Breeding Contract
I,
___________________________________________, herein after referred to as
"MARE OWNER", hereby request a reservation
to the STALLION, Nashboro Gallant Lad, AMHA # 145899, standing at Rail to Trail
Performance Horses/Christine Michelson’s hereinafter referred to as RTPH.
Whereas, MARE OWNER, owns/leases the MARE named

___________________________. MARE OWNER wishes to breed said MARE to said
STALLION during the 20________ season. RTPH’s regular breeding season is from
Feb. 15th through Aug. 15th.
1. BREEDING FEE:
$1000/Non-Colored Morgan Mares -
$1,250/Palomino or Buckskin Morgan Mares - $600/Non-Morgan Mares - includes a
non-refundable booking fee of $200. The Breeding Fee balance must
be paid in full when mare arrives at RTPH. For your
convenience, credit cards are accepted. Starting in 2008 we will be
offering payments for the balance of the stud fee, but only for registered AMHA
mares. The terms will be as follows: Booking Fee: $200 due
with contract. $200 due when mare arrives at RTPH, $200 due when she
leaves RTPH, $200 due at 45 days in foal, and the remaining Balance due
by Nov. 15, of the year in foal.
2. ADDITIONAL FEES:
If MARE is boarded at RTPH and remains here until she is checked in foal, there
are no additional collection and/or insemination fees. However, if you are
just bringing her in during her heat cycle and taking her straight home, the
first cycle collection and/or insemination fees are included in the stud fee.
Any subsequent heat cycles will be an additional $75 A.I. fee per cycle.
3. MARE CARE:
$8 per day dry, $10 per day wet, for boarding of MARE is agreed upon
and due monthly and before MARE leaves RTPH. Mares must be easily handled,
easily haltered, and stand tied. Follicle checks, cultures, pregnancy checks,
and any veterinary treatments will be billed at time of service by attending
veterinarian. All mare care and farrier bills
must be paid in full before mare leaves RTPH.
4. MARE'S HEALTH:
MARE OWNER agrees that MARE is in sound breeding condition, free from
infectious, contagious, and/or transmittable diseases. MARES must be
wormed within 30 days with Ivermectin, vaccinated within 3 months for Sleeping
Sickness, Tetanus, Rhino, and Flu, and UTD on their West Nile vaccinations prior
to their arrival at RTPH. MARE OWNER authorizes RTPH to obtain said
vaccinations if not previously done, at MARE OWNER'S expense. Out of state MARES must have a negative Coggins
Test prior to arrival. It is recommended that ALL MARES be cultured and
have a Breeding Soundness Exam on their cycle prior to arriving at RTPH.
If you are unable to have her cultured and a BSE done, RTPH can have them done
for you. If you choose not to have them done on her first cylce, and
MARE does not conceive on her first cycle, MARE OWNER
authorizes RTPH to obtain said uterine culture and breeding soundness exam at
MARE OWNER'S expense on her second cycle.
5. AUTHORIZATION FOR
EMERGENCY VET CARE: MARE OWNER authorizes RTPH to obtain emergency
veterinary care as in their best judgment is deemed necessary for the well being
of the MARE/foal. Any costs incurred, due to said care, are the
responsibility of the MARE OWNER.
6. PREGNANCY CHECK:
MARE
OWNER agrees to have the MARE examined by an early ultrasound scan between 14
and 18 days from the last day inseminated and notify RTPH of her
pregnancy status. It is suggested that MARE be pregnancy checked again at 45
days.
7. LIVE FOAL GUARANTEE:
If the MARE does not settle or produce a "live foal" (one that stands
and nurses or is hand fed for a period of 72 hours), RTPH agrees to rebreed the
same MARE or an approved substitute the following year on the terms and
conditions provided in this contract with a rebreed fee of $100. MARE must be vaccinated for Rhinopneumonitis at 5th, 7th,
and 9th month of gestation. Failure to do so may result in the loss
of said pregnancy and voids all live foal guarantees. It is agreed that this
provision will be of no further effect if the MARE is taken to any other
stallion before returning to the above-named STALLION unless RTPH and mare owner
make an agreement in writing that RTPH will hold over your contract for another
year. The live-foal guarantee
is valid, ONLY if MARE OWNER has properly maintained the health of the MARE, and
verifies the MARE’S pregnancy loss, stillbirth, or newborn foal’s death by
providing RTPH with an original, signed and dated veterinary certificate, on the
veterinarian’s own practice stationary.
8. REGISTRATION OF FOAL:
RTPH agrees to execute all necessary documents for the registration of the foal
resulting from the breeding. RTPH will not be responsible for registration fees or
DNA testing fees for the foal.
9. NASHBORO GALLANT LAD'S
COLOR GUARANTEE:
Nashboro Gallant Lad is guaranteed to produce Palominos, Buckskins, and
Smokey Blacks on Non-Gray mares.
10.
TERMINATION: Either party may terminate this Contract for failure of other party to meet any
terms of this contract. In the case of any default by one party, the wronged
party shall have the right to recover reasonable attorney’s fees and court
costs as a result of said default. If the STALLION should die, become unfit for
service, be sold, or leased, MARE OWNER will be able to select another STALLION
currently standing and owned/leased/managed by RTPH . If MARE dies or becomes
unfit to breed before producing a live foal, then MARE OWNER may substitute
another MARE approved by RTPH.
11. LIABILITY WAIVER:
MARE OWNER assumes all risks connected with breeding of said MARE and/or foal;
and MARE OWNER agrees to indemnify and hold harmless from liability RTPH,
Christine Michelson, Stallion Management Services, stallion owners, agents, and/or employees from any and all
claims of any nature whatsoever including buy not limited to any loss from fire,
theft, sickness, disease, injury, death or other harm suffered by MARE and/or
foal. Likewise, MARE OWNER assumes no liability for injury, sickness, or
death of STALLION, owners, or employees, caused by MARE and/or foal. MARE
OWNER understands that RTPH/Christine Michelson does not carry any form of
insurance on MARE OWNER'S horses. It is suggested that MARE OWNER carry a
mortality policy on their MARE.

12. CONTRACT IN FORCE:
A photo copy of MARE’S registration papers (both sides), must be returned with
this contract. When Christine Michelson signs, dates, and returns a copy of this
contract to MARE OWNER, it will become the binding contract of both parties.
This contract is not transferable or assignable by either party hereto without
the expressed written consent of the other. In the event the MARE is sold or
otherwise disposed of prior to the birth of the foal, the "Live Foal
Guarantee" will no longer be valid unless specific written consent
or assignment is given to MARE OWNER prior to transfer of ownership.
